Spray Social is a European social network, hosted in France and Italy. This page brings together the legal information relating to its publication and its hosting.

Publisher

Spray Social is published by Jason Houli, founder, acting as a non-professional publisher within the meaning of Article 6 II of French Act no. 2004-575 of 21 June 2004 on confidence in the digital economy.

We consider that knowing who publishes a social network is part of what users are owed. The publisher therefore discloses his identity, without being required to do so by law given his status. His postal details, however, are not made public: in accordance with the regulations, they have been provided to the hosting provider, who holds them at the disposal of the judicial authorities.

Spray Social is currently operated as a brand and trade name. The service is provided free of charge and involves no financial transaction. Should a paid activity be introduced, this notice would be updated and the publisher's full details would be published here.

Hosting

The entire Spray Social infrastructure is hosted within the European Union.

OVHcloud, SAS with share capital of €10,174,560, 2 rue Kellermann, 59100 Roubaix, France, RCS Lille Métropole 424 761 419.

Server locations: Gravelines (France) and Milan (Italy).

Certifications: ISO 27001, SOC 1 Type II, SOC 2 Type II, HDS.

OVHcloud is a French company, not subject to the US Cloud Act or to any other extraterritorial legislation. No data is hosted outside the European Economic Area.

Processors

Spray Social uses a deliberately limited number of providers, all established in the European Union.

Hosting: OVHcloud, France and Italy.

Transactional emails: Brevo, a French company, servers located in the European Union.

Artificial intelligence assistance: Mistral AI, a French company, processing carried out within the European Economic Area.

Mapping: OpenStreetMap and CartoDB, European open source projects. No non-European mapping service is used.

Intellectual property

All elements making up Spray Social, in particular the interface, logos, texts, graphics, software, algorithms and methodologies, are protected by intellectual property law and remain the property of the publisher or its licensors.

The names Spray Social, Prophecy, Prophecies, Fortune Cookie and Plurality Observatory, used in the context of the service, are intellectual property assets of the publisher. Any unauthorised use is prohibited.

Users retain all their rights to the content they publish, under the conditions set out in Section 7 of the terms of service.

Cookies and local storage

Spray Social sets a single cookie, used to remember the chosen display language. The service also uses the browser's local storage to keep the login session and certain display preferences.

No advertising cookies, no third-party trackers, no external analytics tools and no behavioural tracking devices are used.

As these items are strictly necessary for the operation of the service requested by the user, they fall under the consent exemption provided for by the regulations. This is why no cookie banner is displayed: there is nothing to accept.

Local storage can be cleared at any time from the browser settings. Doing so signs you out and, as regards encrypted messaging, permanently destroys the private key and the associated messages.

Reporting and appeals

In accordance with Regulation (EU) 2022/2065 on digital services, any user may report content or behaviour contrary to the law or to the terms of service, using the reporting function built into the service or by email.

Every moderation decision is reasoned and notified. It may be subject to an internal appeal and, where applicable, to a referral to a certified out-of-court dispute settlement body. Decisions taken by automated means may be reviewed by a natural person upon request.

Spray Social may contain links to third-party sites, in particular within content published by users or sources cited during verifications. The publisher exercises no control over those sites and disclaims all liability as to their content, availability and data practices.

This site and its use are governed by French law. The dispute resolution arrangements, including prior amicable settlement and consumer mediation, are set out in Section 20 of the terms of service.
